The statute in one line
The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (commonly called the SARFAESI Act) allows certain secured creditors, such as banks and financial institutions, to enforce security interests over secured assets without first filing a civil suit.
What people usually mean by a "SARFAESI notice"
In practice, borrowers use the phrase for several different communications:
- Section 13(2) demand notice — a demand to discharge the outstanding liability within the statutory period after the account is classified as a non-performing asset.
- Reply and consideration stage — the borrower may make a representation or objection, and the secured creditor is required to consider it and communicate reasons.
- Section 13(4) measures — where the demand is not satisfied, the secured creditor may take steps in respect of the secured asset, including taking possession.
- Possession notice — a notice recording that possession has been or is to be taken.
- Sale or auction notice — publication regarding the proposed sale of the secured asset.
Why the dates on the notice matter
SARFAESI proceedings are time-sensitive. Statutory periods for making a representation, and limitation periods for approaching the Debts Recovery Tribunal under Section 17, run from specific events. Delay can narrow the options available, which is why documents should be organised early.
What you should collect
Loan agreement and sanction letter, mortgage or hypothecation deed, statement of account, the notice itself with the envelope or email showing the date of receipt, any correspondence with the branch, valuation reports, and any part-payment receipts.
